If you’re planning to register your business in the Dubai International Financial Centre (DIFC), you’ll want to understand how intellectual property (IP) laws work here. IP protection in DIFC is quite strong and gives businesses more security compared to federal laws. 

DIFC introduced its own Intellectual Property Law (DIFC Law No. 4 of 2019) to encourage innovation and protect businesses. Before this law, IP disputes were handled by the UAE federal courts. Now, DIFC Courts (which follow English common law) handle IP matters within DIFC. This makes the system clearer and often faster for businesses operating in the free zone.

Who Owns the IP – Employer or Employee?

This is where DIFC law is especially business-friendly:

  • Inventions – If your employee invents something as part of their job, the employer automatically owns it, unless a contract states otherwise. Unlike UAE federal law, employees in DIFC don’t have the right to claim extra pay even if their invention becomes hugely profitable.
  • Copyrights – If an employee creates a design, software, or written material while working for you (or using company resources), the employer is considered the owner. This gives businesses much clearer control over IP created by their teams.

The Commissioner of Intellectual Property

DIFC has an office called the Commissioner of Intellectual Property that enforces the law. They can:

  • Investigate complaints and order violators to stop using your IP
  • Suspend or even revoke a business’s DIFC license if it repeatedly infringes
  • Issue fines between USD 5,000 and USD 50,000 (and double them for repeat cases)

Remedies for Businesses

One big advantage in DIFC is access to injunctions, a quick court order to stop someone from using your IP. This is not usually available under the UAE’s civil law system. On top of that, DIFC Courts can also award financial compensation for damages caused by infringement.

Jurisdiction Limits

Here’s one thing to note: DIFC Courts can handle IP disputes inside DIFC, but if the dispute is about IP registrations (like registering a trademark or patent), it still falls under the UAE Federal Courts. Also, if the dispute involves activity both inside DIFC and outside in wider Dubai/UAE, there may still be some grey areas about which law applies.
