What Is The Biggest PDPO Mistake For Accountants?

Why Accountants Need a Stronger PDPO System

An accounting firm often receives more sensitive information than a normal service business. A simple tax return file may contain identity documents, salary details, residential addresses, family allowance data, bank account details, and company ownership records. An audit file can include employee lists, customer ledgers, invoices, board minutes, and emails.

The main risk is not always hacking. It can involve a junior staff member sending payroll data to the wrong client. It can also involve storing client files in a personal cloud account. Some firms keep old HKID copies longer than needed. Others give an outsourced bookkeeper access to a full client folder.

In 2025 the PCPD received 246 data breach notifications. This was a 21% increase compared with 2024. Common causes included hacking, lost documents, email errors, staff misconduct and system misconfiguration.

Personal Data Privacy Ordinance Accounting Firm Duties

The proper legal name is the Personal Data (Privacy) Ordinance. However, many businesses search for “Personal Data Privacy Ordinance accounting firm” when researching the same compliance issue.

Under the PDPO, a data user is a person who controls the collection, holding, processing, or use of personal data. A data processor processes personal data on behalf of another party and is not directly regulated in the same way. The data user must use contractual or other measures to make sure processors meet the relevant PDPO duties.

For accounting firms, this creates a practical checklist. The firm should collect only the data needed for accounting, audit, tax, payroll, company secretarial or advisory work.

Clients should be told why the data is collected and who may receive it. They should also know how access or correction requests can be made. Personal data should not be used for a new purpose without the person’s express and voluntary consent.

Client Data Controls Accounting Firms Should Use

Area

What The Firm Should Do

Practical Example

Collection

Ask only for data needed for the engagement

Do not request full staff identity copies if payroll totals are enough

Privacy Notice

Give clear collection and transfer details

Add a short Personal Information Collection Statement to onboarding forms

Retention

Keep data only as long as needed for the purpose or legal need

Set different retention periods for tax files, payroll files, and rejected leads

Security

Use access limits, encryption, MFA, and clean folder rights

Audit staff access before busy season and after resignations

Outsourcing

Add processor clauses in vendor contracts

Cover cloud software, offshore bookkeepers, IT vendors, and document storage providers

Access Requests

Track data access and correction requests

Keep one log for request date, response owner, action taken, and refusal reason

PCPD Enforcement Actions Accountants Should Watch

PCPD enforcement actions accountants should watch are often not industry-specific. The lessons still apply because the same data errors can happen in accounting firms.

The PCPD can investigate suspected PDPO contraventions and may issue an enforcement notice requiring remedial or preventive action. Breach of an enforcement notice can lead to fines and imprisonment. A direct breach of a Data Protection Principle is not itself a criminal offence. However, certain PDPO provisions can create offence risk. These include direct marketing rules, erasure duties, and doxxing-related offences.

The regulator’s 2025 work also shows how ordinary workplace mistakes can become PDPO issues. One case involved staff appraisal forms being left in an unlocked drawer. Another involved a scanned employment document being saved in a shared folder. The PCPD found failures linked to DPP3 or DPP4 and urged organisations to build clearer policies, workflows, and training.

Cross-Border Data Transfer Hong Kong PDPO Issues

Cross-border data transfer Hong Kong PDPO planning is important for firms using offshore staff, overseas cloud tools, regional client portals, or group-level systems. Section 33 of the PDPO contains restrictions on transfers of personal data outside Hong Kong. However, PCPD guidance states that section 33 is not yet in operation. Even so, the PCPD recommends cross-border transfer practices as good data governance.

Accounting firms should still map where client data is stored, accessed, backed up and processed. If payroll work is handled by a support team in another country then the firm should define what data is shared and why it is shared. It should also explain how long the data is kept and how it is protected.

The PCPD’s Recommended Model Contractual Clauses cover data user to data user transfers. They also cover data user to data processor transfers. These clauses can be built into wider service contracts.

Data Breach Notification Accountant Hong Kong Steps

Data breach notification accountant Hong Kong planning should be written before an incident happens. The PDPO does not currently make notification to the PCPD a statutory requirement for data users. However, the PCPD recommends notification as a proper breach handling practice. The PCPD also encourages use of its online notification form.

A firm should first contain the breach. This may mean disabling access or recalling an email. It may also mean resetting passwords, isolating a laptop or contacting the cloud vendor.

Next the firm should assess the type of data and the number of affected people. It should also check the risk of identity fraud and the risk of embarrassment or financial loss.

If harm is likely then affected clients and people should be informed quickly with practical steps they can take.

What Directors And Partners Should Check Next

Partners should not leave PDPO work only to IT or admin staff. A useful review starts with four questions. What personal data does the firm collect? Where is it stored? Who can access it? When is it deleted?

The firm should then update privacy notices, client engagement letters, processor clauses, breach procedures, staff training and retention rules.

For example a firm using outsourced payroll support should not simply send full staff files over email. It should use a controlled folder, restrict download rights, add processor terms, and review access after the payroll cycle.

Conclusion

PDPO compliance accountants Hong Kong should treat client personal data as part of firm governance in 2026. The best approach is to collect less, explain clearly, restrict access, control vendors, prepare breach steps, and review cross-border tools.

This protects clients and also gives partners a cleaner system when the PCPD, a client, or an auditor asks questions.
