Sharia law inheritance is not a remote \u201clocal family only\u201d idea; it\u2019s live UAE law, and until fairly recently it could apply broadly, regardless of religion, to people living in the country. Then, in 2023, that changed, and later in 2026 it moved again. The \u201cmath\u201d is set by religious principle, not by your personal wishes, and it covers the whole estate for Muslims unless a will is used where it\u2019s allowed, and within those limits. Those fixed shares generally work like this:<\/p>\n\n\n\n<ul>\n<li>A husband receives one-quarter of the estate if there are children, or one-half if there are no children\u00a0\u00a0<\/li>\n\n\n\n<li>A wife receives one-eighth if there are children, or one-quarter if there are no children\u00a0\u00a0<\/li>\n\n\n\n<li>Sons typically get double what daughters receive\u00a0\u00a0<\/li>\n\n\n\n<li>Parents still receive fixed portions even if adult children exist\u00a0\u00a0<\/li>\n\n\n\n<li>More distant relatives can receive a share if closer heirs are missing\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p>One major point, though, is that UAE law doesn\u2019t run on joint ownership with right of survivorship in the way people sometimes expect. If property is held jointly, the surviving co-owner does not automatically just \u201ctake it over.\u201d Instead, it gets treated as part of the estate, then divided using the fixed heir rules.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-the-one-third-rule-for-muslims\"><strong>What is the one-third rule for Muslims?<\/strong><\/h2>\n\n\n\n<p>Under Article 243 of Federal Decree-Law No. 28 of 2005 (Personal Status Law), a Muslim person can freely distribute up to one-third of their estate using a registered will. That portion can go to practically anyone, like charities, friends, or relatives not in the fixed heir list. The remaining two-thirds have to follow Sharia fixed shares no matter what.<\/p>\n\n\n\n<p>But without a registered will, even that one-third of freedom basically disappears. After the implementation of Federal Decree-Law No. 41 of 2022, the UAE uses a dedicated civil law structure for non-Muslim expats. It can cover UAE financial assets, real estate, free zone company shares, and guardianship of minor children. It\u2019s open to all non-Muslims, no matter which emirate they live in.<br><\/li>\n\n\n\n<li><strong>Abu Dhabi Judicial Department (ADJD):<\/strong> created under Abu Dhabi Law No. 14 of 2021. It uses both Arabic and English and is recognised across all emirates.<br><\/li>\n\n\n\n<li><strong>Dubai Courts Notary Public:<\/strong> available for non-Muslims, in Arabic or a bilingual format. A practical option if someone wants a court-registered will without the DIFC structure.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<p>In general, a registered will under any of these routes overrides the default civil or Sharia distribution for the covered assets.
